Understanding Sales Tax in New Mexico

New Mexico does not have a traditional sales tax. Instead, the state levies a Gross Receipts Tax (GRT) on the gross receipts of businesses doing business in New Mexico. Similar to Hawaii's GET, the GRT is technically a tax on the business, not the buyer, but businesses routinely pass the cost to consumers. The state base GRT rate is 4.875%, but municipalities can add their own GRT rates, pushing combined rates in many New Mexico cities to 8%–9.5%.

Albuquerque's combined GRT rate is approximately 8.3125%. Santa Fe's is approximately 8.4375%. Las Cruces reaches about 8.3125%. New Mexico has over 500 GRT rate combinations across its jurisdictions.

One important distinction of the GRT vs a sales tax: the GRT applies to services more broadly than most state sales taxes. Professional services, consulting, legal services, landscaping, and many other service businesses are subject to the GRT — whereas most US states exempt most services from sales tax. This broader base means New Mexico captures tax revenue from a wider range of economic activity.

New Mexico provides deductions (not exemptions) from the GRT for certain categories including food sold at grocery stores, prescription drugs, sales to the US government, and certain agricultural inputs. These deductions effectively remove these categories from the taxable base. New Mexico also has a deduction for sales to buyers who have paid GRT on the same transaction in another jurisdiction.

The New Mexico Taxation and Revenue Department administers the GRT. Filing is typically monthly. New Mexico has economic nexus provisions for remote sellers consistent with the $100,000 annual sales threshold.

How to Calculate Reverse Sales Tax in New Mexico

To find the pre-tax price from a total that includes the New Mexico sales tax:

Pre-Tax Price = Total Paid ÷ (1 + Combined Rate ÷ 100)

Example at 4.875% state rate: If you paid $107.00, divide by 1.0488 = $102.03 pre-tax, with $4.97 tax.
